Terms of Use

These Terms of Use (hereinafter "Terms") are intended to govern access to and use of the spotli.st platform, published by MBEN DEV (hereinafter "the Company", "we").

The platform allows users to:

• view guides, address lists and digital content;
• purchase these contents;
• publish and sell their own guides (for creator users).

By using spotli.st, the user fully and unreservedly accepts these Terms.

• Platform: the spotli.st website and its associated services.
• User: any person accessing the Platform.
• Buyer: user purchasing content.
• Creator: user publishing and selling digital content.
• Content: guides, lists, maps, digital files published on the platform.

To access certain features (purchase, publication, sale), the user must create an account.

The user agrees to:

• provide accurate and up-to-date information;
• not impersonate a third party;
• maintain the confidentiality of their access.

The Company reserves the right to suspend or delete any account in case of non-compliance with the Terms.

spotli.st acts as a technical intermediary between creators and buyers.

• Creators are legally considered sellers.
• The platform does not sell content but provides a connection space.
• Purchases are made via Stripe Connect Express.
• A 10% commission is charged by spotli.st on each sale.

Details regarding sales are defined in the Terms of Sale for Buyers and Terms of Sale for Creators.

Creators may publish digital content.

They guarantee that this content:

• does not infringe any rights (copyright, privacy...);
• does not contain any defamatory, hateful or illegal information;
• does not reproduce protected content without authorization.

The Company reserves a right of moderation that may include content removal.

The user is prohibited from:

• bypassing site security;
• scraping or mass-extracting content;
• using the platform for fraudulent purposes;
• disrupting the service operation.

The Company reserves the right to exclude anyone who does not comply with these rules.

The Company makes every effort to provide a reliable service but cannot guarantee:

• complete absence of bugs;
• continuous availability;
• accuracy of content published by creators.

The Company's liability cannot be engaged in case of damages related to:

• improper use of the site;
• content published by creators;
• failures or interruptions of external services (Stripe, host, etc.).

The trademark, the name spotli.st, the design, source code and site elements belong to MBEN DEV.

Content published by creators remains their property, but they grant the platform a non-exclusive license to display, host and promote their content.

The user can delete their account at any time.

The Company may suspend or close an account in case of:

• non-compliance with Terms of Use/Sale;
• fraud;
• abusive behavior.

The Company may modify these Terms at any time.

Users will be informed in case of major changes.

These Terms are governed by French law.

In case of dispute, an amicable solution will be sought before any legal action.
